Privacy Policy

This privacy notice is provided to you pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (hereinafter "GDPR") to inform you, in accordance with the principle of transparency, of the methods of processing your data in execution of the contractual relationship with the Data Controller

1. Data Controller

The Data Controller of personal data is Captayn Platform S.r.l., with registered office in Massa, via Dorsale 23A, in the person of its pro tempore legal representative. The Data Controller guarantees compliance with the legislation on the protection of personal data in accordance with the GDPR and provides the following information about the processing of the data communicated or collected.

2. Subject matter of the processing

Pursuant to art. 4, point 2 of the GDPR, the processing of personal data means any operation, with or without the aid of automated means, applied to personal data, such as the collection, recording, organization, storage, consultation, use, transmission or deletion.

The purpose of this privacy notice is to inform users who use the application called Captayn (hereinafter the "App") about the protection of the data processed, the ways in which it is collected, for what purpose it is collected and what the uses are, as well as the individual rights of users.


The App is a mobile platform developed to simplify the management and maintenance of boats.

The App collects and processes personal data of users and associated devices, to provide personalized services and features in line with the purposes of the App. The data will be saved on a secure cloud platform and will not be accessible to unauthorized parties.

3. Purposes of the processing and legal basis

The processing of personal data is aimed at: 

a. Execution of the services requested pursuant to  a contractual relationship: for the performance of the contract relating to the use of the App and associated services. The legal basis is Art. 6(1)(b) GDPR, which allows the processing of personal data when it is necessary for the execution of a contract to which the User is a party. 

4. Type of data processed

The personal data collected may include: 

a. Identification data: first name, last name, date of birth, e-mail address, phone number of the users 

b. Device data: data collected by the device associated with the application (e.g. location data). 

c. App usage data: data relating to the user's interaction with the application and its functionalities

5. Processing methods

The processing of data will be carried out both manually and by automated means, in accordance with the security measures provided for by art. 32 of the GDPR, which requires the adoption of appropriate technical and organizational measures to ensure a level of security appropriate to the risk. The data will be processed in a lawful, relevant and not excessive manner with respect to the purposes for which they were collected.

6. Data retention period

Personal data will be stored for not more than two years form their collection pursuant to Article 5, paragraph 1, letter e) of the GDPR, which establishes that personal data must be stored in a form that allows the identification of the data subjects for a period of time not exceeding that necessary in relation to the purposes for which they are processed. The data may be deleted or anonymised at the request of the user, in accordance with current regulations

7. Recipients of personal data

The personal data collected may be shared with:

  1. Data processors in charge of providing IT, hosting and cloud services, in accordance with Article 28 of the GDPR, which regulates the relationship between the controller and the processor.
  2. Competent authorities or third parties where required by law, in accordance with the legal obligations arising from Art. 6 (1) (c) GDPR.

8. Transfer of data

Personal data is stored on servers located within the European Union. In some cases, they may be transferred to third countries, in accordance with the adequacy decisions pursuant to art. 45 of the GDPR or other guarantees provided for by art. 46 of the GDPR, subject to the user's consent.

9. Rights of the data subject

In accordance with articles 15-22 GDPR, you have the right to:

  1. Access your personal data (Art. 15 GDPR).
  2. Request the rectification of inaccurate data or the completion of incomplete data (Art. 16 GDPR).
  3. Request for  deletion of personal data (art. 17 GDPR), in the cases provided for by the regulation.
  4. Restrict the processing of personal data (Art. 18 GDPR).
  5. Object to processing for direct marketing purposes (art. 21 GDPR).
  6. Request data portability (Art. 20 GDPR).
  7. Withdraw consent at any time without prejudice to the lawfulness of the previous processing (Art. 7, para. 3 GDPR).

Requests  for enforcing  Users right, including  request for deletion can be sent to the following e-mail address office@captayn.com.

10. Nature of the provision of data

The provision of data for the use of the App is mandatory; in the event of failure to provide it, it will not be possible to provide the requested services, as provided for in Article 6, paragraph 1, letter b of the GDPR.

COOKIES

A cookie is a small file that is sent to your browser and saved on your device when you visit a website.
